TIPS:
Our handlers are dedicated to you having a safe and enjoyable experience, and they appreciate your thanks, it is part of their compensation. While tips are not expected, and tips are not included in the base price of parties, they are appreciated so very much. We recommend 15%, 18% or 20%. Your handlers are unsung heroes. In addition to handlers, they are teachers, storytellers and skilled athletes with a true passion for sharing what they love. We put our lives in their hands, and they put their lives at risk for us. It’s easy to factor in the time spent at the party, but many of us forget to factor in all the behind-the-scenes work that goes into handling. When handlers are exceptional, the work looks effortless. But these are just some of the hats they wear: feeding, grooming, tack, teaching, training, conflict resolution specialist. Did my handler take interest in me as a person? Did my handler go out of his or her way to make sure I had a great time? Was my handler skilled in what s/he did? Did s/he have good knowledge and did s/he share it? Did she have a strong service ethic? Was it clear that their actions were focused on our having a superb experience? Find your handlers, shake hands, and say thanks. Then, place the cash in the palm of your handlers’s hand and let him or her know who it is from – individual, family, entire group. Whether or not you tip, please give your handler feedback. If you forget to tip or run out of money, ask us about using a credit/debit card or paypal (although cash is easier for your handlers.)

POLICIES AND PROCEDURES
Including SAFETY RULES, CANCELLATION, RESCHEDULING, SERVICE AGREEMENT, PAYMENT, LIABILITY RELEASE

By making a reservation / booking your event, you understand, have read, and do agree to and will uphold all Terms and Conditions, Policies and Procedures, set forth below. You guarantee to Bella Peregrina Ranch that your event/party date and time are now booked, as long as we confirm availability via email upon making the reservation. Reservations will not be taken over the phone. Reservations must be made through skye.ds@gmail.com. You will then pay your non refundable reservation fee invoice with balance due in full prior to start of services at your event/party. Bella Peregrina Ranch reserves the right to refuse service to anyone or any event for safety reasons at our discretion. On rare occasions an animal or person, may be unwell and therefore not available for the event. Trucks and horse trailers break down or can have a flat tire along the way. We do our best to be there on time and fulfill the time frame you booked. For safety, sufficient adult supervision must be provided to enable us to spend time with the children and ponies.

SPACE AND SURFACE REQUIREMENTS
For the ponies, we recommend at least 12 x 12, 20 x 20 or 30 x 30 spot. The larger the better, but so far, we have always been able to find a place to walk the ponies. We will not walk our ponies on wet or hot asphalt, as this is a safety hazard. Ponies can walk on grass, clean, cool non-slippery pavement, dirt, sawdust, straw and other reasonable walking areas. Ponies can not walk on gravel, rocks, ice, deep sand or hot or wet pavement. Grass may not have been treated with chemical weed killer, pesticide or fertilizers within 5 – 7 days of them working on it, as it is a health hazard.

TRUCK & TRAILER PARKING INFORMATION
To unload our animals and setup, we need to be within 50 feet of our horse trailer. Our truck & trailer is long. A parking space needs to be provided for us. If over 50 ft away from our trailer to set up, we will need assistance from you to assist in unloading. Please locate and reserve a spot for the pony rides that is the easiest, closest and most convenient to enter for set up and to exit for packing up. The ponies are a lot more work than a jump house, clown, train, etc, so please keep it easy for the ponies and handlers. We need at least 6 car lengths space (60 – 70 feet) to park the truck and trailer. We must be able to either pull straight in and pull straight out, or to be able to pull straight in, turn around and pull straight out. If pony rides start late because we can’t park upon arrival, that time will come out of scheduled party time. We won’t add additional time. Please don’t let your guests block us in or take our parking spot; we may have another event after yours. Please keep all your guests and children detained and out of our way while we are setting up or packing up. This is for everyone’s safety. Your time may get cut into if we are attempting to set up and are delayed by others. After your event, we need to be able to pack up, clean up, and leave – please, keep all of your guests away.

SAFETY

HEAT
When it is hot (temperature + humidity – wind speed = 130 or higher) we must have enough shade to work entirely in the shade. We must be able to give the ponies a break from work if needed. We must have a water hose nearby to provide fresh water. When it is hot, the best times for pony rides are 8 am – Noon and 5 pm – 9 pm. We reserve all rights for the safety of our ponies and to ensure you have a quality time at your event with the animals.

PARTICIPATION
No riding double – 1 child at a time on a pony. Please do not allow guests (children or parents) to run around, under, behind or in front of the ponies. We ask that all children line up in a line and wait for their turn, because this will help us not be delayed in walking the ponies so each child can enjoy riding the ponies. Locate noisy and active games in an area away from the ponies. Speak quietly and move slowly as sudden movements and loud sounds can startle. Keep toys far away from the pony area. Keep motorized and battery operated toys away from the pony area. No Dogs. No Exceptions. No Balloons / balloon Artists near ponies; balloons go POP and may get in a pony’s eye! Please keep all of the following as far away from the ponies as possible: bounce houses, toy guns, balls and other thrown toys, trash or hitting near or on ponies.   No yelling, smacking, hitting, running around, screaming, balloons or toys, food or other dangerous behaviors on or around the ponies. Children will be asked to line up in a line and wait for the pony handler to call them over to pony. No child is allowed to walk next to the pony when the ponies are walking without permission from the pony handler. Unless otherwise permitted by pony handler, only adults/guardian/parents may walk along side the pony.

DOGS
NO DOGS near ponies:  Dogs may be very dangerous as they nip, bark and chase ponies so please keep them locked up. Please keep all dogs and any other animals restrained or put away during the event. If there is a loose dog, the ponies will be stopped until the dog is put away. Excited or intimidating dogs that rush at ponies can be a serious safety hazard. This is for the safety of the children and the dog. Dogs barking, biting, charging or nipping at our ponies and horses are serious safety hazards. For the safety of your children, our ponies and our horses, please put away or keep inside all dogs during pony rides. Until dogs are put away or kept inside, we won’t run rides. If any of our ponies or horses are injured or killed because your dogs get loose, you are legally liable and responsible for veterinary bills or replacement animal costs. Because not all ponies and horses are appropriate for this kind of work, Bella Peregrina Ranch will select replacement ponies and horses.

NO WET SWIMSUITS: Please provide towels to keep our saddles dry, if you are having a water slide or pool party.

CHILDREN ARE TO HOLD THE SADDLE HORN AT ALL TIME. PLEASE DON’T ALLOW A PARENT/GUEST TO TELL THEIR CHILD TO DO ANYTHING ELSE.

SHOES are required for both kids and adults and need to be worn around ponies, preferably with closed toes. Absolutely NO bare feet!! Please NO sandals or open toes near pony hooves.

DO NOT FEED PONIES WITHOUT PERMISSION
Ponies may be fed apples, carrots, and other treats (peppermints, cookies, cake, trail mix, watermelon, other melons, etc) only with permission from the pony handlers. Ponies may be fed treats after services have been provided. Ponies may not be fed treats before or during service.

WEIGHT LIMITS
Pony: 120 lbs
Stock horse: 240 lbs
Draft horse: 340 lbs
Parent or adult must help lift children onto Ponies.  Please make sure your guests are courteous and help the pony handlers out.  Children must be 1 year old to ride with parent or adult walking along side pony.  If your child is younger/toddler/smaller; please walk with and hold your child while on the pony.  Please make sure you order the right size of pony or horse. For the sake of our ponies and horses, we will turn riders away if they are too large to ride.

AGES and ADULT INTERACTION REQUIREMENTS
Children must be at least the age of 1 yrs old to ride pony. Children under the age of 3 years old must have parent/guardian or adult walk with them next to ponies and help hold the child. These children do not have the balance that older children have, so please help us hold your baby. Failure to do so is the parent/guardian’s own fault. We require parents (or other family members) to help load their children onto the ponies for several reason- Stranger Danger – By the child having their parent or adult friend lift them onto the pony, this makes sure that no one is accidentally grabbing a child the wrong way. Plus, the children don’t really know us, but they know their parents or other family members. This will help the pony handler make sure that the pony stands and waits for the child to be loaded. This way we don’t accidentally pull on a pony’s face while trying to load a child on. If a pony’s face is tugged on, then the pony may walk forward. By having an able parent (dads are great!) load their child onto the pony, this is bonding time. The parents are watching, laughing, taking pictures and keeping an eye on their children. Plus the parent can then have the opportunity to get as many cute pictures as they would like of their child riding a pony after being loaded. You would not just put your small/younger child on a ride at Disney Land without accompanying them or making sure that they are properly loaded. If a pony handler is injured, no more rides. Pony handlers are at an event to walk the ponies and have fun with the kids, not to break their backs picking up and unloading hundreds of children per day. If we break our backs, then we won’t be able to attend other events to share the magic. We hope that all the parents or adult supervisors who brought the children to the event would want to participate, have fun, interact and get great pictures of the children after they have helped load them onto the cute, clean and well behaved pony. Pony handlers may offer to assist at their discretion, but please do not expect it of them.

BAD WEATHER – PLEASE BE ADVISED FOR ALL EVENTS:
Cancellation due to severe bad weather may be applied to another available date at the discretion of Bella Peregrina Ranch. Rain alone is not severe bad weather. Examples of severe bad weather include but are not limited to close lightning strikes, hail, snow, ice, flood, fire, tornado, hurricane, earthquake. Bella Peregrina Ranch must be notified of the change before we leave the farm. Cancellation is based on our best judgement of the weather situation. There are no refunds; however upon our best judgement and determined by circumstances, we might allow an event or party to be rescheduled to an alternative date in case of severe inclement weather. We might also allow the non refundable reservation fee to be applied to another service such as a real world riding lesson or trail ride.

ADDING / SUBTRACTING SERVICES
You may add services as long as you do so before we leave the ranch.  We may or may not be able to honor a request to change your date and time.  You may not delete services. We do not deduct our services from what you originally booked with us because we have already committed those services to you. If you request a particular service, and we keep that particular service just for your party, but then you request to not have that particular service, then that is not only unfair to us, but it is unfair to all the other clients who had called in and requested that particular service be a part of their special celebration and were denied, because we designated them just for your event.

LIABILITY RELEASE

I, we, as a guardian/parent, supervisor,or responsible party, acknowledge the risks and potential risks of horseback/pony riding, including risk of bodily injury or death resulting from kicks and bites, falling off horse/pony or horse/pony falling on rider, being dragged by a foot caught in the stirrups, being thrown by horse/pony, equipment failure or collision with horses/pony or vehicles or other inanimate objects. I hereby, intending to be legally bound for myself, my children, my heirs and assigns, executors or administrators, waive and release forever all claims for damages against Bella Peregrina Ranch, its board of directors, instructors, therapists, volunteers and/or Employees for any and all injuries and/or losses I may sustain as a result of use of Bella Peregrina Ranch on the property, equipment, or facilities. Ride At Your Own Risk. Participate at your own risk. Riding helmets are strongly recommended but not required. Bella Peregrina Ranch does not supply helmets (please see helmet policy below). If you or your guests choose not to have your child wear a helmet, then they waive all rights and assume all risks and liabilities Involved with injuries involved without wearing helmets.

WARNING! UNDER TEXAS LAW (CHAPTER 87, CIVIL PRACTICE AND REMEDIES CODE), A FARM ANIMAL PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN FARM ANIMAL ACTIVITIES RESULTING FROM THE INHERENT RISKS OF FARM ANIMAL ACTIVITIES.

CROWD CONTROL:
Bella Peregrina Ranch is only responsible for the services agreed upon. You are responsible to see to it that all guests follow safety rules, policies and procedures. Please have an adult supervisor or security person to make sure that everyone follows safety rules. We do not offer crowd control service.

CANCELLATION & RESCHEDULING POLICY:

Bella Peregrina Ranch has a No Cancellation Policy.  Cancellation forfeits your non refundable reservation fee.  Bella Peregrina Ranch agrees to provide services as described above to the best of our ability.  Client agrees to the terms both written and verbal, and will make sure guests follow them.  This agreement for your Party/Event is secured by paying the invoice for the non refundable reservation fee to us and we confirm your event date and time are still available.

The non refundable reservation fee also bonds this agreement. By paying this invoice, you are promising & guarantee that you are serious about your booking, and will not cancel your booking.  Reservations are not guaranteed without the non refundable reservation fee in order to cover transportation costs and staff costs.  By paying the non refundable reservation fee invoice, client confirms that you agree to all terms for hire, policy, procedure, cancellation policy and that you will enforce them with your family, friends, event coordinators, party planners, participators, guests, spectators or anyone involved or associated with your event/party or in the general location of your event.

If you choose to cancel your event for any reason, your non refundable reservation fee is non-refundable.  We reserved your event date and time in good faith, along with other arrangements and preparation, which means if you cancel the reservation, we have lost out on any other bookings and reservations, which may have been booked.  This is why we have a No Cancellation Policy. Not only do we lose out on your event, but all other events, if you cancel. This is unfair to us. You do not want us to cancel your reservation; we expect the same courtesy.

All events are “rain or shine” unless otherwise stipulated. You are responsible to provide an alternate indoor or shelter/shade location if it should rain. You agree to pay the full amount contracted once we have arrived at the event location even if we cannot perform due to severe bad weather. You agree to pay full remaining balance if you decide to cancel the event. If event is re-scheduled due to severe bad weather, you may reschedule your event to the next available date due to severe bad weather; this must be done prior to us loading ponies and leaving the farm or arriving at your event.  The non refundable reservation fee is non-refundable, regardless of time of cancellation.

If canceling event; you must contact us in writing via email, phone call or text messaging as soon as possible, and before we leave the farm.  If the event is cancelled due to factors out of our control, including but not limited to weather, or any other unforeseen reason, there will be no refunds.  Bella Peregrina Ranch reserves the right to cancel the event if any of the conditions outlined in the Terms and Conditions, Policies and Procedures are not met on the day of the event. Full payment is still due at that time.  For example, if the crowd is behaving dangerously around the ponies, the event will be cancelled.

Cancellation of the engagement by you for any reason shall forfeit the non refundable reservation fee.  Bella Peregrina Ranch will have legal right in pursuant of any fees, fines or money therefore owed for acceptance of services from Bella Peregrina Ranch, whether performed or canceled.  If Bella Peregrina Ranch or you must cancel the engagement due to an Act of God, “Force Majeure”, riot, strike, epidemic, or by the order of any public authority, this contract shall become null and void, and both parties shall have no further legal recourse against each other.

RESCHEDULING POLICY:

Rescheduling Or Exchanging original booked service for another – If for any reason we are able to allow an party/event to be rescheduled or exchange a booked service for another – party pony rides exchanged for riding lessons or trail ride – full payment is required immediately for all money owed for the original event booked. Full payment must be paid to Bella Peregrina Ranch immediately and prior to the date the original party/event was scheduled.

The same event may only be re-booked for a mutually agreeable and available date and time within 12 months of the cancellation, based on availability. We will also allow the non refundable reservation fee to be applied to another service such as a real world riding lesson or trail ride.  If we are able to re-schedule the event, then the remaining balance will be due to Bella Peregrina Ranch before confirming the re-scheduling of the new event’s date. This is to insure that the event will not be cancelled or re-scheduled on again, as this hurts us financially, preventing us from booking other events on that day and time.

If your event/party must be cancelled due to factors out of our control, i.e. severe bad weather, and you would like to reschedule, the original deposit will be transferred the new scheduled date of the event. Customer must contact Bella Peregrina Ranch prior to departure of the farm and/or driving/arriving to your event, otherwise full payment is due upon arrival.  If you cancel or re-schedule by phone or text message, you must also verify that cancellation in writing via email.

PAYMENT POLICY
Non refundable reservation fee is non-refundable unless otherwise indicated.  Balance is payable to Bella Peregrina Ranch by cash, credit, debit or paypal prior to services provided.  We do not accept checks or money orders.

NON REFUNDABLE RESERVATION FEE
Small private parties: 50% is required within 7 days to reserve your event date and time.
Large events: Full payment of price quoted.is required within 14 days of booking to reserve your event date and time.
Reservations are not guaranteed without receipt of non refundable reservation fee. Non refundable reservation fees are due within 5 business days of booking your reservation.  Non refundable reservation fee is Non-Refundable.

REMAINING BALANCE OWED:
Remaining balance is due via cash, credit, debit, paypal. We do not accept checks or money orders.  Remaining balance is due upon our arrival and prior to set up at your event.  You may pay balance at anytime before your event via cash, credit, debit or paypal (3.25% card processing fee will apply).

PUBLIC VENUES AND PARKS: It is your responsibility to contact the public venue or park to make sure that pony rides are allowed. Permits and Permit Fees are your responsibility. We won’t offer refunds if we aren’t allowed to work because we’re asked to leave.

CLEAN UP: We provide clean up. Manure makes the best natural, organic fertilizer. Let us know where to spread it for you.

NEVER TRUST YOUR HEAD IN SOMEONE ELSE’S HANDS (CAUTIONARY NOTE ABOUT LOANER HELMETS)
Why we do not provide loaner helmets– loaner helmets are not safe for a number of reasons:
Helmets must be fine tuned to fit different head shapes – oval or round shape. We cannot guarantee proper fit.  Helmets must be replaced every five years or after an accident. This is largely based on use, exposure to the elements and treatment of the helmet. However, due to evolving helmet standards, technologies and the potential for unseen material deterioration, it is recommended that helmets be replaced at least every five years from the date of purchase. Any helmet involved in an accident needs to be replaced immediately. Helmets are only designed for one impact. We know whether our helmets are less than 5 years old, and whether or not they have been in accidents, but you do not.
Avoid using loaner helmets. As a savvy rider, you want to know exactly what kind of treatment your helmet has experienced during its entire lifespan so you can knowledgeably assess its integrity over time. (never mind the risk of spreading head lice)
